Terms of Service

1. Acceptance of Terms

By accessing or using TheFAQApp (“Service”), operated by TheFAQApp (“we,” “our,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of the Service, including visitors, registered users, and API consumers.

2. Description of Service

TheFAQApp is a FAQ management platform that allows you to create, organize, publish, and serve FAQ content. We provide tools for content creation, AI-assisted writing, analytics, embeddable widgets, and a REST API with SDKs for programmatic access.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security and confidentiality of your password
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access or use

You must be at least 16 years old to create an account. If you are registering on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Your Content

You retain ownership of all content you create on TheFAQApp. By using our Service, you grant us a limited, worldwide, non-exclusive license to host, display, and distribute your content solely as necessary to provide the Service.

You are responsible for ensuring your content does not:

  • Violate any applicable laws or regulations
  • Infringe on third-party intellectual property rights
  • Contain malicious code or harmful content
  • Harass, abuse, or threaten others
  • Spread misinformation or fraudulent content

5. Acceptable Use and Fair Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to our systems or infrastructure
  • Interfere with or disrupt the Service or its availability
  • Scrape, crawl, or collect data from the Service without written permission
  • Impersonate others or misrepresent your affiliation with any entity
  • Use automated systems to abuse or overload the Service

Fair Use Policy

Each plan includes resource allocations (storage, API calls, FAQ pages). Usage significantly exceeding normal patterns may be subject to rate limiting or require a plan upgrade. We will notify you before taking any action and provide a reasonable period to adjust your usage.

6. API Usage

Access to the TheFAQApp API is subject to the following additional terms:

  • API keys are confidential. You are responsible for securing your keys and must not share them publicly.
  • Rate limits apply to all API endpoints. Current limits are published in our API documentation.
  • We may revoke API access if usage violates these Terms or poses a risk to platform stability.
  • API responses may be cached on your end, but you must respect cache-control headers and not serve stale data beyond the indicated TTL.

7. Subscription and Billing

Paid plans are billed in advance on a monthly or annual basis. You can cancel at any time, and your access will continue until the end of your current billing period.

  • Refunds for annual plans may be provided at our discretion within 14 days of purchase.
  • We reserve the right to change pricing with at least 30 days’ notice. Price changes will take effect at the start of your next billing cycle.
  • If payment fails, we will attempt to collect for up to 14 days before suspending access to paid features.

8. Service Level

We strive to maintain high availability for the TheFAQApp platform. While we do not guarantee specific uptime percentages for all plans, we commit to:

  • Providing reasonable advance notice of planned maintenance windows
  • Communicating promptly about unplanned outages via our status page and email
  • Working diligently to restore service in the event of an outage

Enterprise customers may request a formal Service Level Agreement (SLA) with specific uptime commitments and remedies. Contact hello@thefaq.app for details.

9. Data Processing

When you use TheFAQApp to collect or manage personal data from your end users, you act as the data controller and we act as the data processor. In this capacity:

  • We process data solely according to your instructions and as necessary to provide the Service.
  • We maintain appropriate technical and organizational security measures.
  • We offer a Data Processing Agreement (DPA) upon request that complies with GDPR requirements.
  • We will promptly notify you of any data breach that affects your data.

10. AI Features

Our AI features are provided to assist with content creation. AI-generated content may not always be accurate, complete, or appropriate for your use case. You are solely responsible for reviewing, editing, and approving all content before publishing.

AI-generated content does not represent the views or opinions of TheFAQApp. We make no warranties regarding the accuracy or suitability of AI outputs.

11. Intellectual Property

The Service, including its design, code, branding, and documentation, is owned by TheFAQApp and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary materials without prior written permission.

Your use of the Service does not grant you any rights to our trademarks, logos, or brand assets.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THEFAQAPP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Termination

We may suspend or terminate your access to the Service for violation of these Terms, for prolonged inactivity, or for any other reason at our reasonable discretion. We will provide notice when feasible.

You may delete your account at any time through your account settings. Upon termination, we will make your content available for export for 30 days, after which it may be permanently deleted.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes at least 30 days in advance via email or through a prominent notice in the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or relating to these Terms or the Service shall be exclusively resolved by the competent courts of Amsterdam, the Netherlands.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
